Privacy notice: Call for Sites
The Council has a duty to process and store your personal information safely, securely and transparently in line with UK data-protection legislation. This includes the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any subsequent amendments or related legislation as updated from time to time. North Norfolk District Council is the data controller for the purposes of the UK GDPR and associated domestic law.
How we will use your information
By submitting this form, we will collect your personal data to:
- evaluate the site(s) submitted
- contact you, if necessary, regarding information provided in your submission
- assist in the preparation of the statutory Local Plan
- inform and update you about the preparation, consultation and examination of the North Norfolk Local Plan and related statutory planning policy documents. This includes notifying you of future consultation stages where you have previously expressed an interest or engaged in the Local Plan process.
If you choose to submit representations as part of the Local Plan process at a later stage, a separate privacy notice will apply. Representations may be published in accordance with planning regulations.
We may also use your personal information to identify and engage with relevant groups as part of our plan-making duties, and to document the involvement of consultees at various stages of plan production.
Lawful basis for processing your data
The lawful basis for processing your personal data is Article 6(1)(e) of the UK GDPR - processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority and has a clear public interest and basis in law.
The processing of personal data is necessary for carrying out the duty of preparing a Local Plan, a statutory function undertaken by the Council under the Planning and Compulsory Purchase Act 2004 and associated regulations.
Providing your information allows us to include you in Local Plan consultation communications. This processing is carried out under the Council's public task, rather than consent.
Who we share your information with
Details of Call for Sites submissions may be published and made publicly available. However, personally identifiable information (for example, your name, email, phone number) will not be published.
We may share your personal data, where necessary, with parties involved in the preparation and examination of the Local Plan. This may include the Planning Inspectorate, an independent Programme Officer appointed to support the examination, and other organisations or service providers acting on behalf of the Council.
We will only share your data where there is a lawful basis to do so, and appropriate safeguards are in place. Any data that we consider to be sensitive personal data that you choose to include in connection with your representation, will be omitted from any documents included on our website and for inspection. However, we will still hold the full consultation response in order to make an informed decision on the content of the Local Plan.
How long we keep your information
The Council will retain your personal data for as long as necessary to fulfil the purposes described above. This will typically be for the duration of Local Plan preparation and examination, and any subsequent period required to respond to legal challenge or meet statutory record-keeping requirements, in accordance with our records retention schedule.
Your rights
You have the right to request access to any personal information that we hold about you (a Subject Access Request). You also have the right to request that we update, complete, correct, restrict, erase, or transmit your data to another organisation. These rights are not absolute and there are circumstances where they do not apply or the Council may override these rights. However, if this is the case, you will be informed of this.
We do not make automated decisions in respect of these services.
As we are relying on a public task as our lawful basis, you also have the right to object to the processing of your personal data. Where you do so, we will consider your request and may need to retain certain information where necessary to fulfil our statutory duties. Requests may be sent to data.protection@north-norfolk.gov.uk
