Information about fly-tipping

We are lucky to enjoy plenty of beautiful landscapes here in North Norfolk.
Maintaining a space that residents and visitors can enjoy requires a collective responsibility to look after our environment, which includes ensuring waste is disposed of responsibly and safely.
When a fly-tip occurs, North Norfolk District Council will always investigate, and endeavour to take action against perpetrators.
It is important to note that when a fly-tip occurs on private land, the Council cannot be responsible for its removal, as this responsibility lies with the landowner under the Environmental Protection Act 1990 (EPA 1990).
Under Section 59 of the Act, the Council has powers to require landowners to remove unlawfully deposited waste from their land, but the legislation does not permit the Council to clear or dispose of waste on private property at public expense.
A spokesperson for the Environmental Protection Team said:
“We understand that fly-tipping can be distressing and frustrating for landowners. The law prevents councils from clearing waste from private land.
However, our Environmental Protection Team will investigate all reports of fly-tipping, and where possible, take action against those responsible.
Do remember that there are things landowners can do to help facilitate that process to increase the chances of a successful outcome.”
The Council encourages landowners to:
- Report fly-tipping incidents immediately.
- Avoid disturbing the waste, as it may contain hazardous materials.
- Record details such as photographs, vehicle registration numbers, and dates/times to assist with investigations.
- Arrange safe removal of waste through a registered waste carrier — you can check licences on the Environment Agency’s website.
Fly-tipping on public land or highways should still be reported to North Norfolk District Council, who will arrange for removal where appropriate.
By working together, residents, businesses, and landowners can help keep North Norfolk clean, safe, and free from illegal dumping.
